Square Enix Guidelines on Streaming and Posting Gameplay Videos and Images

Square Enix Co., Ltd. (“Square Enix”) permits you to distribute, post online, and otherwise use certain content from KINGDOM HEARTS Melody of Memory (the “Game”) subject to the following terms (the “Terms”). These Terms apply only outside of Japan; if you are located in Japan, or have obtained a Japanese version of the Game, please see the Japanese license for terms that apply to you.,Please carefully review and comply with these Terms before distributing, posting, or otherwise using any Materials (as defined below), including distributing or posting the Materials on blogs or social networking services. Any distribution, posting, or other use of the Materials by you constitutes your agreement to these Terms. You may not reproduce or distribute the Materials without Square Enix’s prior permission or as authorized by these Terms.

1. The Materials

The “Materials” consist of all content from Kingdom Hearts Melody of Memory, including, but not limited to, gameplay footage, still images, characters, and music from the game.

The Materials are the property of Square Enix’s licensor, Walt Disney Japan Co., Ltd. (“Disney”). Other than the Permitted Uses below, the Materials may not be used without the express written permission of Disney. Square Enix reserves the right to change the terms under this Guideline in our discretion at any time. Please make sure to check the permissions under this guideline regularly.

The below music tracks are licensed and *not* included in the Materials (“Licensed Music Tracks”). Stages and/or cutscenes that feature the Licensed Music Tracks not covered under Permitted Uses.

2. Permitted Uses

You may post the Materials online for the following permitted uses (the “Permitted Uses”) for non-commercial use only:

Posting gameplay images on personal blogs or microblogging platforms (such as Twitter).
Sharing gameplay videos (including those containing background music) on video-sharing sites such as YouTube so long as the video sharing site has a licensing agreement with the applicable performance rights organization.

The Permitted Uses are limited to non-commercial or personal use. Standard ad revenues may be enabled for streaming.

3. Legal Notices

You must clearly display the following information on all gameplay videos and any other content that incorporates the Materials:

Some consoles’ built-in sharing functions may add this information automatically when sharing videos and screenshots. If you use such images and videos without modification, it is not necessary for you to add the information manually.

NOTE: It is not necessary to include information concerning rights holders and prohibitions on reuse when posting to microblogging platforms (such as Twitter).

4. Usage Guidelines and Restrictions

You may not use the Materials except as expressly described in the Permitted Uses above. You may not use any other materials owned or controlled by Square Enix without Square Enix’s prior written consent.

Additional Restrictions:

In order not to spoil players’ enjoyment of the Game, you must mark all content that includes details of major plot developments with a clear spoiler warning.
You may only use Materials from an official licensed copy of the Game.
Do not stream or upload videos or screenshots of any scene if native gameplay recording is blocked for that scene (e.g., the ending).
Any content created by you must comply with any applicable regulations and laws, including for example, the platform’s terms of use.
Do not reproduce shared content other than as expressly contemplated by these Terms. For example, you must not collect and distribute Materials via other media—e.g., in book form—even if you do not stand to gain financially from doing so.
Do not make any misleading representations. Examples) claiming the content created by you was “approved by” or is “official” (without a separate written agreement in place).
Do not share Materials on paid sites or services. (This restriction does not apply to premium Niconico accounts.)
Do not share Materials on sites or services that are intended only for those aged 18 and over.
Do not share the Materials on offensive sites, or on sites that violate public order and morals.
Do not share the Materials on sites related to religious, political, or anti-social activities.
Do not slander or demean other players or any other person in connection with the Materials.
You must immediately comply with any request from Square Enix to remove Materials from any shared content, website, or service, regardless of whether Square Enix provides a reason for the request or not. Square Enix reserves the right to require removal of any content incorporating the Materials that it deems to be inappropriate in its sole discretion. Square Enix may submit takedown requests to third parties for any Materials at Square Enix’s sole discretion.
Neither Square Enix nor Disney makes any guarantees concerning the Materials, including that the Materials will not infringe third party rights. Square Enix will not compensate you or any third party for any damages or injuries that arise as a result of use of the Materials.
Square Enix may modify these Guidelines at their sole discretion at any time without prior notice.
